Terms of Service

These terms govern your use of rocknearthworks.com.au, operated by Rock'n Earthworks Pty Ltd (ABN: 51 628 792 503). By using this website, you agree to these terms. We may update them from time to time, and the current version will always be available here.

Fees and conditions

Standard pricing is on the services page. The fees below cover the extras and apply only when they kick in. Same wording shown on the services page so nothing changes between the two.

1. 01Travel charge. $8.99 per kilometre from Cockatoo 3781. Charged once per project. Punch in your post code to our travel calculator on the quote form to calculate costs.
2. 02Site establishment fee. If we aren't already at your property because we came to Complete a Driveway Restoration Or install a Rock Your Number We charge a site establishment fee of $250.
3. 03Service location fee. If we are digging more than 200mm deep and a site assessment has shown the potential for buried gas, power, water or a comms line (NBN/phone/internet) A Service location fee of $395 is required.
4. 04Hourly rates. Excavation, Material management and Restricted/Challenging access are quoted additionally of listed prices when required. Charged at $250 per hour for One Rock'spert, Charged at $350 per hour for Two Rock'sperts (4 hour minimum).
5. 05Away from home allowance. Projects which take longer than a single working day and are outside a radius of 75kms from Cockatoo 3781 (as the crow flies) will be charged an additional $350 per Rock'Spert, per evening, away from home allowance to cover accommodation/fuel costs.
6. 06The Rock Clause. When the ground is Hard packed or Rocky, Jackhammer worthy. If Rock is encountered and plans cannot be adapted around the existing rock under the surface, applicable Prices will increase by 50% to cover additional machinery and labour costs. Or in worst case circumstances the project will be paused and requoted (at the sole discretion of Rock'n Earthworks).
7. 07Permits. No road occupation permits (or other relevant council permits) included. Client is advised that the works will require occupation of the road with machinery and or materials. Any council fines incurred due to not obtaining relevant permits in advance will be the responsibility of the client.
8. 08Plans and Drawings. All quotes to include a Video mud map design, Phone video recorded Walking the job whilst explaining the project details, upload as part of the job description, Physical paper job design and drawings can be provided at additional cost, priced individually
9. 09Payment Terms. 10% deposit to lock in contract, 30% paid on arrival first day on site, 60% paid on completion of quoted works. Mobile EFTPOS available
10. 10Guarantee. All works completed by Rock'n Earthworks Pty Ltd are performed in accordance with industry best practices and comply with the National Construction Code. We operate to all OH&S requirements and are fully insured.

Services and quotes

We make every effort to describe our services accurately, but do not warrant that descriptions, pricing, or availability are error-free. All prices are in AUD and include GST unless stated otherwise. Quotes provided through our website are estimates only, subject to site inspection. We may correct pricing errors at any time.

Your consumer rights

Our services come with guarantees under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded.

• Major failure: you can cancel and receive a refund for the unused portion, or compensation for the drop in value
• Minor failure: you are entitled to have problems rectified in a reasonable time
• You may also be compensated for any other reasonably foreseeable loss or damage

Nothing in these terms limits your rights under the Australian Consumer Law.

Limitation of liability

Subject to your consumer rights above and to the maximum extent permitted by law: we are not liable for indirect, incidental, special, or consequential loss from your use of this website. Our total liability is limited to the amount you have paid us in the 12 months before the claim, or the cost of re-supplying the relevant service.

Privacy

We handle your personal information under our Privacy Policy and the Privacy Act 1988 (Cth).

Content you submit

If you submit content through this website or social media (form submissions, videos, giveaway entries), you grant Rock'n Earthworks a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content for its intended purpose, including marketing and promotional materials. You warrant that your content does not infringe third-party rights or contain unlawful material. We may remove content that breaches these terms.

Driveway Giveaway Terms · Promoter

Rock'n Earthworks Pty Ltd, ABN 51 628 792 503, Cockatoo VIC 3781. Regulated by the Victorian Gambling and Casino Control Commission (VGCCC). Trade promotion lottery under the Gambling Regulation Act 2003 (Vic), Part 4, Division 2. No permit required.

Driveway Giveaway Terms · Entry

Free. No purchase necessary. $0 cost (maximum permitted: $1 incl. GST). One entry per residential address. Entries open 1 May 2026 and close 28 June 2026 or when the 1000-entry cap is reached, whichever comes first. Follow Rock'n Earthworks on at least one social media platform, submit the entry form with your name, email, phone number, and a Victorian residential address within the Rock'n Earthworks service area, then post a pic or short video of your driveway on social media tagging Rock'n Earthworks (@rocknearthworks on Instagram and TikTok) to confirm eligibility.

Driveway Giveaway Terms · Eligibility

Victorian residents aged 18+. Must own or rent property with an existing crushed rock driveway in the Rock'n Earthworks service area (Dandenong Ranges and surrounds). Employees and their immediate families are not eligible.

Driveway Giveaway Terms · Prize

One driveway restoration valued at up to $1,200 incl. GST. Scope includes regrading, crushed rock, compaction, and drainage assessment. Coverage, materials, and final scope determined by on-site assessment. Not transferable or exchangeable for cash.

Driveway Giveaway Terms · The draw

On 28 June 2026, by random selection using bingo-style numbered balls at a community venue. Filmed and published on social media. You do not need to be present.

Driveway Giveaway Terms · Winner notification and delivery

Notified by phone or email within 7 days. If no response within 14 days, the prize is redrawn. The promoter's decision is final.

Delivery within 28 days of confirmation, subject to weather and site access. Driveway must be accessible by tipper truck and excavator. The winner agrees to the restoration being filmed for marketing.

Prize is under $1,000, so newspaper publication is not required. Winner announced via social media and draw video. First name and suburb published unless the winner requests otherwise.

Governing law

These terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the Victorian courts. If any provision is found invalid, the remaining provisions continue in full force.
